Terms of service
About Makschill
Makschill is operated by Steen Commerce AS, a company registered in Norway (organisation number 935 934 621). These terms explain the use of our online store and purchases made through it. We sell through a website powered by Shopify.
These terms must be read together with the product information, delivery information, returns and refunds policy and privacy policy available through our store. Nothing in these terms excludes, restricts or changes rights or remedies that cannot lawfully be excluded, including rights under Australian Consumer Law.
Using our website
Please use our website lawfully and do not interfere with its operation, security or other users. You must not introduce harmful code, try to access systems without permission, use the website for fraud or misuse material in breach of intellectual property rights.
We may restrict access where reasonably necessary to protect the website or comply with law. You are responsible for the information you provide when creating an account or placing an order.
Products and descriptions
We aim to describe products accurately, including their features, sizes, colours, compatibility and any important limitations. Product images may look different depending on your screen. Please read the listing and select the correct variant before ordering. Contact us if you need clarification.
Availability and product ranges can change. We may limit quantities or refuse an order for a legitimate reason, including suspected fraud or stock unavailability, subject to applicable law and any rights you have when an order has already been placed.
Prices, payment and order confirmation
We aim to display clear prices and the total amount payable before an order is placed, including taxes, duties and unavoidable fees where required by law. Any applicable shipping charges will be shown as part of checkout before you confirm payment. The available payment methods are those shown at checkout.
Submitting an order starts the checkout and order-processing process. We will send the relevant order or payment confirmation to the email address you provide. Keep that confirmation for your records.
If we find an incorrect price, description or availability notice, we will contact you promptly and explain the issue. We will seek a fair and lawful resolution, which may include honouring the order, agreeing to a correction or arranging a cancellation and refund where appropriate. We will not treat a pricing error as an automatic right to cancel a paid order. Any resolution will respect your legal rights.
Delivery
Delivery information, including the current estimate for Australia, is explained in our Shipping policy. An order may be sent in more than one parcel or from outside Australia. We will assist with delivery issues and do not seek to remove your statutory rights because a parcel has been handed to a carrier.
Returns, refunds and consumer guarantees
We provide the remedies required by Australian Consumer Law when applicable consumer guarantees are not met. Depending on the circumstances, this may include repair, replacement, refund or other remedies. A separate voluntary return arrangement never replaces these rights. See our Refund policy for the procedure and contact details.
Account details and communications
Provide accurate contact and delivery details so we can confirm, fulfil and assist with your order. If you create an account, keep your login details secure and let us know if you suspect unauthorised use. Order-related emails may be needed to perform the contract or provide customer service.
Customer content and reviews
If you choose to submit a product review, question or other content, it must be lawful and reflect your own experience. You retain ownership of your original content. By submitting content for publication, you permit us to display and use it in connection with the store to the extent needed for the intended feature, subject to your rights and any applicable platform terms. We may moderate content for lawful and reasonable reasons, but we will not represent invented reviews as genuine customer experiences.
Third-party tools and links
Our store uses services provided by Shopify and may link to websites or features operated by third parties. Their separate terms and privacy notices may apply. We are not responsible for independent third-party websites, except where applicable law makes us responsible.
Website availability and liability
We work to keep the website operating, but occasional maintenance, interruption or technical errors may occur. To the maximum extent permitted by law, we are not responsible for losses resulting solely from circumstances beyond our reasonable control. This does not affect liability or remedies that cannot legally be excluded, including under Australian Consumer Law.
Changes to these terms
We may update these terms for future use of our website or future orders. Changes will be made available on the website. Changes do not remove statutory rights or retrospectively alter an existing purchase in a way that the law does not allow.
Applicable law and disputes
Steen Commerce AS is established in Norway. Any reference to Norwegian law does not exclude the Australian Consumer Law rights that apply to purchases offered directly to Australian consumers, or other mandatory protections that may apply. Please contact us first so we can try to resolve any concern fairly.
